How Do I Get Out Of A Lease I Signed With My Girlfriend?

I signed a one year lease under my name because I have ok credit, and my gf does not. She is also put on the lease, but it is in my name. She also put her sister as the dependent which is probably why we got the apartment. We fight and you know how it goes, I want to either turn the apartment over to her and leave or keep it and leave her on the lease. Is this possible? What should I do?

  1. Trouble says:

If the lease is on your name, you are legally obligated to fulfill the terms of the lease.
You can break the lease or move out, but will remain liable for the rent until either a replacement teant is found or the lease expires. You can be held liable for any costs the landlord may incur due to your breach.
You cannot remove your name from the lease.
It sounds as though your girlfriend would not qualify for the lease on her own.

  2. Jools says:

You can ask your landlord if he/she can transfer the lease to her. She will likely have to undergo another credit check.
I don’t know whether or not your landlord would be willing to do this. The best part is probably to kick her out, and not worry about her name being on the lease.
